Anna Nicole Jury Selection Begins: Do You Have What It Takes?

Were you called for jury duty in Los Angeles County this week? And, if so, do you believe that doctors, hospitals and pharmacies should be permitted to use an alias or false name to protect a celebrity's privacy?

 

That's one of 107 questions being presented to the pool of prospective jurors in the upcoming trial of Anna Nicole Smith's companion, Howard K. Stern, and two of her doctors, all of whom are accused of facilitating the prescription-drug habit that ultimately killed her.

 

And aside from the usual "Have you ever been convicted of a crime?" portion of the questionnaire, both the prosecution and the defense want to know a lot about the 12 men and women (plus three alternates) they ultimately pick to sit on their jury.

For starters (actually, question No. 44), people are being asked where they get most of their news and entertainment and whether they follow celebrity cases in particular ("e.g.: Mel Gibson, Lindsay Lohan, etc.").

 

There's also a lengthy section on pretrial publicity, and presuming the potential juror hasn't been living under a rock for four years, he/she could have a lot of explaining to do regarding how much they've heard about Smith's life and death, as well as the death of her son, Daniel, her relationship with Stern and Larry Birkhead, and her daughter, Dannielynn.

 

Both sides also want to know whether jurors ever watched The Anna Nicole Show on E! (No. 67) and, if so, how many episodes, and whether they caughter Smith's rather loopy appearance on the American Music Awards (No. 68), where she asked the audience if they liked her TrimSpa-slimmed body and introduced "my boy, Kanye West!"

 

Then there's the part about doctors, and whether you've ever had any bad experiences with one or more of them, have friends who are doctors, or have ever considered suing one.

 

"Should doctors be treated differently from others if they break the law?" asks question No. 86. (We're thinking the answer to that one matters.)

 

Then the potential jurors are asked if they've ever had a prescription drug problem or suffered from conditions such as chronic pain or a psychological or emotional condition.

 

"Have you, a relative, or friend ever been prescribed, or do you have any familiarity with, any of the following," the questionnaire asks, thereby listing 51 drugs, from Ambien to Xanax.

 

That's a pretty broad question, but hey, the lawyers have to invade everyone's privacy be thorough, right?

 

The 14-page form wraps up with a lenghty list of potential witnesses and asks people to indicate whether they personally know a person, saw him/her on TV or the Internet, or don't know of him/her at all.

 

Among the more recognizable names among the 94 on the list, which includes dozens of doctors, are Larry Birkhead and Dr. Cyril Wecht, the privately hired pathologist who performed autopsies on Smith's son Daniel and, later, on Smith herself.

 

Opening statements are scheduled to begin Aug. 4 and the trial is expected to last roughly three months.

 

Stern, psychiatrist Khristine Eroshevich and physician Sandeep Kapoor have pleaded not guilty on all counts.

Anna Nicole Smith’s little girl Dannielynn is five years old now and she seems to get prettier every day. Will she have an awkward phase? Her dad Larry Birkhead is carrying her backpack and papers as they leave school. Since Dannielynn won’t be inheriting any money from the Marshall family fortune (Anna Nicole wed the billionaire J Howard Marshall briefly before he died.) She may grow up to have fewer designer handbags, but a more normal life. Larry’s probably not too happy about it, though.

EXCLUSIVE: Judge Grants Howard K. Stern Title To Home Occupied By Dannielynn Smith And Larry Birkhead

Howard K. Stern, the one-time love of Anna Nicole Smith and the acting executor of her estate, was granted the right to transfer the title of a home purchased by the late actress – a home currently occupied by her surviving child, Dannielynn, and her natural father, Larry Birkhead, RadarOnline.com can reveal.

 

According to court documents obtained exclusively by RadarOnline.com, Smith - aka Vickie Lynn Marshall - purchased the home in April 2005 using the name Vickie Lynn Marshall but within one day of buying the home, transferred the deed to one of her companies, Hot Smoochie Lips, Inc.

 

Stern had requested to transfer the title of the home from Hot Smoochie Lips, Inc. to himself, as the executor of her estate. The judge granted his request Tuesday.

 

In the documents filed in Los Angeles Superior court, Stern stated: “Petitioner believes that the Decedent's intent in transferring title to the Corporation was to protect her privacy, and that she inadvertently used the Corporation as the entity to do so rather than establishing a new entity for the purpose of owning the Home.”

 

Stern also stated that “Anna Nicole and her daughter. Danielynn Hope Marshall Birkhead, resided in the Home. For continuity, following Anna Nicole's death, Danielynn, a minor who is also the sole beneficiary of the Estate, and Larry E. Birkhead, Danneilynn's natural father, have resided in the Home and continue to do so. The Home therefore has not generated income for the Estate”

 

Stern claims that since Smith’s death, “the Estate has made all mortgage, utility and hazard insurance payments on the Home.”

 

It is unclear if Stern immediately intends to sell the home, and if so, where Dannielynn or Birkhead will go.

 

An attorney for Stern tells RadarOnline.com that no determination has been made on what is to be done with the property.

 

Neither Stern or Birkhead were present in court and Birkhead provided no objections to the petition.

Felony Charges Dismissed Against Howard K. Stern

Howard K. Stern had a good day in court.

 

A Los Angeles judge dismissed two conspiracy felony charges against Stern, 42, on Thursday, ruling there was no evidence he intended fraud or deception when he got drugs for his former client and lover Anna Nicole Smith under fake names.

 

L.A. County Superior Court Judge Robert J. Perry also dismissed the two conspiracy charges against Dr. Khristine Eroshevich, 63, a psychiatrist who was Smith's neighbor, and rejected a charge against her of unlawfully prescribing a controlled substance. He also reduced a fraud charge to a misdemeanor and sentenced Eroshevich to a year of probation.

 

Eroshevich wept at the news and Stern smiled broadly.

 

Outside court, Stern said that he was thinking about Anna Nicole Smith and her legacy after the judge's decision.

 

Smith 'Vindicated'

"I was looking in the sky, thinking she was being vindicated," said Stern, his voice cracking with emotion. He said the prosecution wrongly tried to represent Smith as a weak-willed drug addict who was being overwhelmed by improperly and unnecessarily prescribed medications.

 

"She was an incredibly strong person and smart – nobody could take advantage of Anna," he said, explaining that after her son Daniel died, "she was in terrible pain."

 

In a statement after the decision, the L.A. District Attorney's office said, in part: "Judge Perry’s ruling today is totally inconsistent with his previous rulings at the preliminary hearing, the trial itself and once again when the defense concluded their case. Each time, he refused to dismiss the conspiracy counts. The evidence has not changed from that time to now."

 

The statement added, "His decision denigrates the substantial investigative efforts conducted by the state Department of Justice and the Medical Board. It diminishes the huge social problem of prescription drug abuse facilitated by irresponsible caretakers and unscrupulous medical professionals. ... We will immediately pursue all appellate remedies to overturn Judge Perry’s decision."

 

Reason to Protect Smith

Judge Perry said he was rejecting the conspiracy charges because the prosecution failed to prove that Stern was aware it was a crime to get a prescription for a celebrity under a fake name. (In this case, he used the moniker Michelle Chase.)

 

He also added Stern had good reason to want to protect Smith against the possibility that the media might find out she was on methadone and other dangerous medications.

 

"There was no evidence that Howard K. Stern lacked a good faith belief that what he was doing could be against the law," said Perry, who also found that Smith was not an addict, which was one of the key component's of the prosecution's theory.

 

 

 

Oooh, I guess that's why I didn't know what happened to him - nothing. :rolleyes:

She really is beautiful. You just have to hope she escapes the demons of her life. I know you see her every once in a while, but I have hopes that she gets To live a semi-normal life.

Maybe this was a pre-Derby event? It looks like they are in different clothes.
