SILVERMANpeople.com<strong>ImClone Systems founder Sam Waksal -- whose insider-trading scandal also ensnared his friend Martha Stewart -- will be trading his jet-setting ways for seven years and three months in prison.</strong>Citing Waksal's "lawlessness and arrogance," Manhattan Federal Judge William Pauley on Tuesday <strong>also sentenced the 55-year-old former CEO to pay nearly $4.3 million in fines and back taxes, the Associated Press reports.</strong>"The harm that you wrought is truly incalculable," said Pauley, ordering Waksal to report to prison July 2. Until then, he will wear an electronic monitor and remain under house arrest in his posh SoHo loft.The stiff sentence is being seen as a bad omen for Stewart, 61, who last week was indicted on charges stemming from her December 2001 sale of ImClone shares one day before the FDA declined to approve of one of the biotech company's new cancer drugs, Erbitux.Prosecutors say Stewart was acting on a tip from Waksal. Stewart has pleaded not guilty to the charges.Last fall, Waksal admitted that he tipped his daughter, Aliza, to dump her ImClone shares in December 2001. Waksal has not publicly implicated Stewart, AP notes.In court Tuesday, with his entire family in attendance, Waksal pleaded in a broken voice for mercy, apologizing to cancer patients for any delay the investigation might have caused in approval of Erbitux."I am deeply distressed and so very sorry for my actions," he said. "I want to apologize to all the people who may have had confidence in me and whose confidence I betrayed."He also said, according to New York's Daily News: "I feel great remorse for what I did, but I do not feel bitter."After his sentencing, Waksal reportedly hugged his brother and his 80-year-old father inside the courtroom. He did not address the crush of camera crews and reporters waiting outside.

New York's Daily News reports that "Living" will now air at 2:07 a.m. -- if you can call that living</strong>. Her former slot will likely go to "Living It Up," with Alexandra Wentworth (wife of George Stephanopoulos) and former ABC newsman Jack Ford.

SILVERMANpeople.com<strong>Bad economic news for Martha Stewart : Her company announced Monday that its second-quarter net earnings fell 86 percent, with little hope for recovery this year, the Wall Street Journal reports.</strong>Such news from Martha Stewart Omnimedia Inc. is being viewed as yet another sign that the legal woes plaguing the domestic diva over an insider stock trading scandal remain an albatross for the once-thriving firm, notes The New York Times.Stewart, 62, faces trial in January on federal charges stemming from her sale of ImClone Systems shares -- essentially on charges of obstructing justice during the Justice Department's investigation of her. Stewart has maintained her innocence throughout.<strong>Stewart's company, reports The Times, has been in high gear over the past 14 months (since the scandal first broke), producing items that do not bear the Martha Stewart name.</strong>This includes bringing in experts from other fields and using their names on products and on programs, such as pet expert Marc Morrone.The company's Martha Stewart Living core brand remains under "significant pressure" until Marta's legal status is resolved, the company's new CEO, Sharon Patrick, who took over for Stewart, tells the Journal.

SILVERMANpeople.com<strong>The new issue of Martha Stewart Living magazine is missing a feature that has been a mainstay of the publication since its founding 13 years ago: Martha's Calendar.</strong>The New York Times interprets the move as an attempt by the magazine's parent company, Martha Stewart Living Omnimedia, to play down the name and personality of the lifestyle guru, who is currently involved in an insider stock-trading scandal.Stewart, 62, speaking to The Times, downplayed the replacement of her bylined monthly guide to deadheading flowers and other domestic duties with a feature now called Gentle Reminders."When we started the magazine in 1990," she said, " there were very few calendars in other magazines offering that kind of gentle reminders that I wanted to offer our readers."But with other magazines picking up her calendar idea (her printed list also included the birthdays of friends and her daughter, Alexis), "we believe it is time to evolve our calendar to something different."Stewart emphasized that the magazine was simply looking for a way to do something better. "That's what it's all about," she tells The Times. "It's not about anything else."

It has become a veritable piece of folklore in Mount Desert Island, Maine, the tale about Stewart asking to use the phone at the Seal Harbor General Store shortly after moving into the old money enclave. When the cashier tells Stewart that customers must use the pay phone outside, she shrieks, "Do you know who I am?" The frumpy old man on line behind Stewart then asks, "Do you know who I am?" To which Stewart replies, "I haven't the faintest idea." Flipping a quarter at her, the man announces, "I'm David Rockerfeller . Now here's a quarter. We all use the pay phone around here." But Rockefeller tells W it's just a tall tale. "Not that it's a particularly bad one," he laughed.

During the sit-down, Stewart admitted the prospect of doing jail time frightened her. "Who wouldn't be scared? Of course I'm scared," she said. "The last place I would ever want to go is to prison. And I don't think I will be going to prison, though." In the meantime, can't we all just focus on her freakin' salad???

SILVERMANpeople.com<strong>A weary-looking Martha Stewart and a jury that is trying her heard further testimony Thursday in Manhattan federal court from a former Merrill Lynch assistant who painted a portrait of the domestic diva as shrill, rude and constantly complaining</strong>.Stewart, 62, who is not on trial for complaining, is charged with obstructing justice by lying to federal authorities investigating possible insider trading of her shares of the ImClone biotech stock. She is also charged with misleading investors in her own company, Martha Stewart Omnimedia Inc.Her broker, Peter Bacanovic, 41, is similarly charged with obstruction of justice. Both have pleaded not guilty.Describing his telephone relationship with Stewart, Bacanovic's former assistant, Douglas Faneuil, 28, compared the sound of her voice to "a lion roaring underwater" and said, "I have never ever been treated more rudely by a stranger on the telephone," reports Reuters and other news sources.While David Apfel, Bacanovic's lawyer, attempted to present a case that it was Faneuil's dislike of Stewart that led the ex assistant to make up stories about her for federal prosecutors (Faneuil swung a deal and pleaded guilty to the feds, in exchange for a lighter sentence), <strong>Fanueil's witness-stand replies often had Thursday's courtroom laughing out loud, reports The New York Times</strong>.Asked by Apfel if he had told prosecutors that Stewart "told you she was going to leave Mr. Bacanovic and leave Merrill Lynch unless the hold music (on the telephone) was changed," Faneuil replied that it was true about the threat, but that "this is one conversation with Ms. Stewart I chose not to tell Peter about."<strong>The defense team also showed the jury some e-mail messages that Faneuil sent to his friends and which had newscasters on New York's morning shows cackling among themselves early Friday.Said one Faneuil e-mail: "I have never ever been treated more rudely by a stranger on the telephone. She actually hung up on me." Said another: "Martha yelled at me today but I snapped at her face and she actually backed down. Baby put Ms. Martha in her place."</strong>
