LOS ANGELES (Zap2it.com) - Filmmaker Tim Burton, director of darkly fantastic films such as "Edward Scissorhands" and "Beetlejuice," has
become the proud father of a new baby boy.It is the first child for the 45-year-old and his fiancee, actress Helena Bonham Carter, who he met on the set of his remake of the sci-fi classic "Planet of the Apes," reports the AP.
The boy, who has not been named yet, was born in London on Saturday, June 26.
The couple lives in adjoining London houses connected with a tunnel and has no immediate plans to wed. "I don't know if we'll marry," says Bonham Carter. "I find it romantic bearing his illegitimate child and living next door."The actress was nominated for a best actress Oscar for 1997's "The Wings of the Dove." She most recently starred in Burton's Oscar-nominated "Big Fish."
Burton is also known for "Pee-Wee's Big Adventure," "Batman," "The Nightmare Before Christmas," "Ed Wood" and "Sleepy Hollow." He is currently filming an adaptation of the Roald Dahl children's book "Charlie and the Chocolate Factory" starring Johnny Depp as the wacky candy maker.
These two have to be one of the oddest couples in Hollywood I think. I bet they would be fun friends

Actress Helena Bonham Carter was left baffled yesterday morning when news spread across America that she'd given birth over the weekend - eight months after her first child actually arrived. Reports on the Planet Of The Apes star currently grace the pages of a number of the nation's respected publications - including USA Today, the Washington Post and the Miami Herald - stating that she and director Tim Burton welcomed their first child into the world on Saturday. But Billy Ray was actually born in October, and her representatives in London insist she's not conceived another child since giving birth. A spokesperson says, "The only child she gave birth to was in October, 2003." It has yet to be revealed exactly how the mix-up occurred.

Thanks for the link, desperately! Of course I love Bonham Carter and thinks she looks great in these new clothes/costumes even if 95% of us couldn't pull it off. It does help having a British garden to take tea in to wear them.
Great to know she and Tim Burton are doing so well. I think both are very talented and I love their 'different' way of looking at life and style. Being the weirdo I am, I'd much rather look at them as a couple then the Tomkats or Brangelinas.

Isn't it awesome to see people that look REAL and don't conform to some "Hollywood" ideal and yet still look sexy and beautiful and intriguing? He's got the greatest hair in the world. I bet he never combs it and I adore him for it, and her for loving him.

Helena Bonham Carter sees beauty in the bizarre

'I was never like the women in the costume dramas,' says Bonham Carter, pictured above in her latest film, 'Conversations With Other Women,' with Aaron Eckhart.
For a lesson in onscreen image alteration, look no further than Helena Bonham Carter.
Some 10 years after she first came to prominence in "A Room With a View" (1985), the physically demure English actress - whose new film, "Conversations With Other Women," opens Friday - changed her image in the mid-'90s from what many saw as the classic English rose to a risk taker drawn to thornier stuff.
Where formerly there had been a big-haired waif in a high-waisted empire dress in "View" - followed by "Hamlet" (1990), "Where Angels Fear to Tread" (1991) and "Howards End" (1992) - there was soon a Gothically patched-together bride of Frankenstein, a wheelchair-bound disease sufferer desperate to lose her virginity and a suicidal nut job who fakes serious medical conditions for kicks.
"I was never like the women in those costume dramas," she says wearily. "People assumed I was like that in real life, but of course it was just acting.
"There was the whole Asquith thing [Bonham Carter is, in real life, the great granddaughter of the aristocratic Herbert Henry Asquith, prime minister of England early in the last century], and I was labeled. But it was all a half-truth. I'm a completely different mix."
Indeed. No matter the box office performance of the films, Bonham Carter, 40, has bloomed in these darker, edgier roles in films like "Mary Shelley's Frankenstein" (1994), "The Theory of Flight" (1998) and "Fight Club" (1999). Even her Academy Award-nominated role in 1997's "The Wings of the Dove" seemed to hinge the two worlds, at least emotionally: In it, Bonham Carter plays a 1910 Londoner whose plan for upward mobility is to have her lover woo a dying rich girl.
"I am attracted to eccentrics," Bonham Carter explains. "I love watching people who are cut from a different cloth. I think, 'How on earth did they get to be like that?' It makes [acting] fun.
"And I've never been interested in what other people think," continues Bonham Carter, who says she's proud when she appears on those snarky "Worst Dressed" lists and prefers black, baggy clothes that swamp her petite figure. "I have been vilified for my dress sense, and I find it hilarious."
The actress' appreciation of eccentrics surely led her to director Tim Burton, her partner of several years and father of Bonham Carter's 3-year-old son, Billy Ray. The couple met on the set of "Planet of the Apes" in 2001 (she played a humanitarian chimpanzee) and currently have a kooky - though oddly fitting - domestic arrangement in her native London: "We live in two houses which are interlinked by a kind of tunnel," she says. "It's perfect.
"I just knew that Tim was the one," she adds, recalling the start of their relationship. "It wasn't so much an intellectual thing, but a complete gut knowledge. It was like: 'Oh my God!'" She went on to co-star in Burton's "Big Fish" (2003) and "Charlie and the Chocolate Factory" (2005) and also provided the voice of the comely title cadaver in Burton's stop-motion animated "Corpse Bride" (2005).
Coming up, she'll play the perfectly named witch Bellatrix Lestrange in next summer's "Harry Potter and the Order of the Phoenix." And though she says she and Burton have no immediate plans to marry ("I'm his woman, and we have a little bastard as a son - I find it quite romantic," she laughs), the couple may be considering another baby.
"Billy was so wanted and came at exactly the right time," says Bonham Carter, who has cut down her workload since his birth. But with another mouth to feed, Bonham Carter jokes that she might be foolish to pursue art-house movie roles - which rarely boost the bank balance - instead of higher-profile work.
"It's probably rather stupid because I should have done a bit more of what people call 'commercial' films," she says. "But I knew 10 minutes into reading the script for 'Coversations With Other Women' that I'd do it. It was like a chemical reaction. And it ended up being one of the most satisfying things I've done."
In the indie "Conversations," Bonham Carter plays a married woman who comes to New York from the U.K. to be a bridesmaid at a friend's wedding, meets a man from her past (Aaron Eckhart) and spends the night with him. "The script was so literate and intelligent and had characters I could recognize," she says.
The entire film is in a split-screen format - familiar to viewers of shows like "24" - and was shot with cameras trained on both actors constantly.
The unorthodox style, of course, was an attraction for her. "We had a camera on each of us at all times, which meant we were doing more acting than waiting around [on set]," she says. "In a normal film, there's no chance to get into something that much because of the stop-start-waiting around.
"This kind of film allows for proper characterization, almost like a play. It's an actor's dream."

Director Tim Burton has been sued for fraud by his former lover, Lisa Marie, according to court documents obtained by PEOPLE.
In a suit filed Wednesday in Los Angeles Superior Court, Marie, who describes herself as an actress, model, artist, writer and photographer, claims that Burton owes her palimony from their 10-year relationship, and that after their split she'd settled for a lesser amount under false pretenses. TMZ.com was first to report the suit.
She says she and the Charlie and the Chocolate Factory director, 48, began dating beginning around December 1991, and that when they began living together they agreed to combine their earnings, with Marie serving as Burton's personal manager. She also says Burton promised to support her for the rest of her life.
In August 2001, Burton abruptly ended their relationship, news that the court papers call "totally unexpected" and which made Marie "extremely depressed and emotionally unstable for months thereafter."
Around the same time, Burton began dating actress Helena Bonham Carter, 40, whom he met while directing her in 2001's Planet of the Apes. They now have a son together, Billy-Ray Burton, 3.
Marie claims that after Burton left her, his associates, claiming they were acting on her behalf, conspired with Burton to fraudulently convince her that she had little chance of winning a palimony claim. Burton even held secret talks with one of her close friends, a woman named Cherry Vanilla, in a plot to convince Marie to settle.
As a result, she accepted a settlement of their Fifth Avenue apartment in New York City and a Jaguar. She now wants to rescind the settlement agreement and is seeking unspecified damages.

Tim Burton to make 3-D "Alice in Wonderland"
LOS ANGELES (Hollywood Reporter) - Tim Burton has signed a deal with the Walt Disney Co. to direct and produce 3-D movies based on Lewis Carroll's "Alice in Wonderland" and his own short film "Frankenweenie."
The "Alice" adaptation, combining live-action and performance-capture technology, will start shooting in early 2008.
Burton will then start work on a full-length version of his 1984 cult favorite "Frankenweenie," about a pet dog who is brought back to life by his loyal owner in a very unusual way. The film will be shot in stop-motion animation.
Burton is putting the finishing touches on the Johnny Depp musical "Sweeney Todd," which DreamWorks/Paramount will release domestically next month.

I saw the play while it was on broadway and it was just AMAZING - it was hands down one of the best scores I have ever heard. I rarely leave any play with a CD but I walked out with one while at Sweeny Todd.. CAN"T wait for the film

Lest anyone get the wrong idea, Carter, who stars with Johnny Depp in Burton's new movie musical Sweeney Todd, says, "We're not that dark. What I love about Tim is that he retains a certain innocence and a childlike quality. He sort of forgot to grow up. I think I've definitely forgotten to grow up, which is great."

NBR picks 'No Country'
Tim Burton picks up directing award

The Coen brothers’ “No Country for Old Men” from Miramax-Paramount Vantage was named best picture of the year by the National Board of Review, while Tim Burton was tapped best director for DreamWorks-Warner Bros. musical “Sweeney Todd.”
There’s always a certain amount of mystery surrounding NBR, a group made up of film educators and other professionals with no official Hollywood ties, but the org’s yearly announcement is considered an early bellwether of potential awards winners, as well as being the first among top 10 lists that begin rolling out in December.
George Clooney picked up NBR’s best actor nod for his performance in Warner Bros.’ “Michael Clayton,” while Julie Christie was named best actress for her role in “Away from Her,” from Lionsgate.
NBR named Disney-Pixar’s “Ratatouille” best animated feature, while French film “The Diving Bell and the Butterfly” took the award for best foreign film. Phil Donahue and Ellen Spiro’s Iraqi war docu “Body of War” was tapped best documentary. Ben Affleck won for best directorial debut with “Gone Baby Gone.” Both “Gone” and “Diving Bell” are distributed by Miramax.
In previous years, the NBR included the winning film in its list of top films of the year. This go round, the org changed its rules to keep the year’s best film separate, creating one more slot on the top 10 list.
Warners took three of the spots on top 10 roster; Andrew Dominik’s “The Assassination of Jesse James by the Coward Robert Ford,” Rob Reiner’s “The Bucket List” and Tony Gilroy’s “Clayton.” Vantage took two with Sean Penn’s “Into the Wild” and Marc Forster’s “The Kite Runner.”
“Sweeney,” which DreamWorks-Paramount is distributing domestically, also made the list, as did Focus Features’ “Atonement,” Universal’s “The Bourne Ultimatum,” Fox Searchlight’s “Juno” and MGM-Sidney Kimmel’s “Lars and the Real Girl.”
“We screened 328 films and the diversity of these narratives is reflected in our 2007 Ten Best Films,” NBR prexy Annie Schulhof said. “’No Country for Old Men’ is a brilliant convergence of extraordinary directing, a masterful screenplay, and incredible ensemble performances.”
A number of the films landing on the top 10 roster haven’t opened yet domestically, meaning distribs will try to use to the NBR mention to up the profile of their pics. They are Joe Wright’s “Atonement,” which opens Friday, “Kite Runner,” which opens Dec. 14, “Sweeney,” which unspools Dec. 21 and “Bucket List,” which opens Christmas Day.
“Juno,” which opened Wednesday, will look for an immediate boost. Ellen Page won NBR’s prize for breakthrough performance by an actress for her role in “Juno,” while Emile Hirsch earned the breakthrough performance by an actor for “Into the Wild.”
Best ensemble cast went to “No Country.”
“Juno” scribe Diablo Cody and “Lars and the Real Girl” scribe Nancy Oliver tied for the best original screenplay prize, while best adapted screenplay went to Joel and Ethan Coen for “No Country,” based on the tome by Cormac McCarthy.
Making NBR’s list of top 10 independent movies were Sarah Polley’s “Away from Her,” Craig Zobel’s “Great World of Sound” (Magnolia Pictures), John Sayles’ “Honeydripper” (Emerging Pictures) Paul Haggis’ “In the Valley of Elah” (Warner Independent), Michael Winterbottom’s “A Mighty Heart” (Vantage) and Andrew Wagner’s “Starting Out in the Evening” (Roadside Attractions).
Searchlight scored four of the spots on the indie list with Mira Nair’s “The Namesake,” Tamara Jenkins’ “The Savages,” John Carney’s “Once” and Adrienne Shelly’s “Waitress.”
Making the shortlist of best foreign films were “4 Months, 3 Weeks and 2 Days,” “The Band’s Visit,” “The Counterfeiters,” “La Vie En Rose” and “Lust, Caution.”
“Darfur Now,” “In the Shadow of the Moon,” “Nanking,” “Taxi to the Darkside” and “Toots” were named top five docus.
Kudos will be handed out at during a Jan. 15 gala dinner at Ciprani’s in Gotham.
Michael Douglas will receive NBR’s career achievement award, while the William K. Everson Film History Award will go to Robert Osborne. Roger Deakins will receive the award for career achievement. The BVLGARI Award for NBR Freedom of Expression will go to films “The Great Debaters” and “Persepolis.”

Helena Bonham Carter Has a Baby
Helena Bonham Carter and her director beau Tim Burton have welcomed their second child, PEOPLE has learned exclusively.
The infant, born in London late Saturday, joins big brother Billy, who is 4.
"They are absolutely delighted they have a daughter," the actress's rep, Karon Maskill, tells PEOPLE. "It's a lovely Christmas present for the family."
Bonham Carter, 41, and Burton, 49, have had a busy time of late. Both were nominated for Golden Globe awards for Sweeney Todd – she for best actress, he for best director. In fact, they got that news while at the doctor's office.
"We were talking about inducing, and Tim got a call from his assistant," Bonham Carter told PEOPLE before the birth. "I do look like a globe, so it's kind of funny. I am very round."
She also joked that it was probably hard on the baby while in utero to listen to Mom learning how to sing for her role in the musical. "Maybe the baby's going to come out with his hands on his ears. 'Shut up!' " she laughed.
She added that the anticipation of meeting the new baby was intense. "I just can't wait," she said. "It's hard to imagine we can make anything other than Billy."
The couple revealed the pregnancy exclusively to PEOPLE in August.

Director Tim Burton and his Hot Topic spokesfamily go for a walk around chilly London in Hampstead on Wednesday (the day after Christmas).
Burton, 49, was accompanied by actress wife Helena Bonham Carter, 41, and son Billy-Ray, 4.
Helena gave birth to a daughter nearly two weeks ago, tomorrow.
Tim’s most recent movie Sweeney Todd: The Demon Barber of Fleet Street, a blood-gushing adaptation from Stephen Sondheim’s 1979 hit, is out in theaters now. It came in 5th at the box office this past weekend, pulling in a healthy $9.4 million. Hollywood, keep making more musicals!

Tim Burton and Helena Bonham Carter have named their six-week-old daughter Indiana Rose, according to reports.
The actress gave birth to the couple's second child on December 16, but have kept tight-lipped about the new tot's name.
A spokesperson for the British star refused to confirm the news, but confessed to WENN, "It's probably likely."
German Web site VIP.de claims Burton and Bonham Carter waited until now, because they were expecting a brother for 4-year-old Billy Ray, so had only thought up boys names, reports Page Six.

My favorite street peddler from the 1800s, Helena Bonham Carter and Tim Burton, were out in London last night. They were probably celebrating her win as Best Actress for Sweeney Todd at the Evening Standard Awards.
Even though they are going into a restaurant, they look like they are lost and wandering the streets. They always look like that. They have this look like "where am I....can I have a haypenny?" They must smoke a lot of weed.

LOS ANGELES - Mediation talks collapsed between Tim Burton and his ex-girlfriend, who claims she was cheated out of her rights to assets that the director promised her during their nearly decade-long relationship, attorneys said.
The legal fight is scheduled to play out before Los Angeles Superior Court Judge Harold I. Cherness on Aug. 12.
Lisa Marie, a former Calvin Klein model, met Burton at a club in 1991 and went on to star in several of his movies while the couple lived together. Burton broke up with her nearly 10 years later.
In December 2006, Marie sued Burton, saying he promised her that they would "combine their efforts and earnings and would share equally any and all" accumulated property. The lawsuit also claimed that Burton said he would financially support her for the rest of her life.
After the split, Marie said she consulted with an attorney who told her she would have little chance of prevailing in a palimony suit, the lawsuit said. Marie claims the lawyer colluded with Burton and persuaded her to enter into contracts with the director that deprived her of her rights.
According to court papers filed by Burton's lawyer, the director gave Marie $5 million to sign a contract releasing him from any further claims to his assets. He maintained that if she wanted to rescind the contract, she was obligated to return the money.
Burton countersued Marie in September seeking a court declaration that his ex-girlfriend was bound by prior agreements.
The director cast Marie in several of his films, including "Ed Wood," "Mars Attacks!" and "Planet of the Apes." It was while filming the "Planet of the Apes" remake in 2001 that Burton met Helena Bonham Carter.
Burton and Carter eventually became a couple. The actress gave birth in December to her second child with the 49-year-old director.

WB, Paramount dominate Saturns
'300,' 'Harry Potter' lead the way

Warner Bros. and Paramount dominated feature film nominations for the the 34th annual Saturn Awards.
Warners scored 23 noms, most of any studio, and its Frank Miller sword-and-sandal epid "300" led all films with 10 noms. "Harry Potter and the Order of the Phoenix," also from Warner, had nine noms.
Par had 22 noms, including noms for Daniel Day-Lewis for actor, a pair of noms for "Cloverfield" and another pair for "Tranformers."
In TV, "Lost" led with seven noms, "Dexter" nabbed five and "Heroes" had four.

Disney unveils new schedule
'Old Dogs,' 'Hannah Montana' set release dates

With the writers strike resolved, Disney is the latest studio to rejigger and give more shape to its release calendar through 2009 and the early part of 2010.
The Mouse House has staked out opening dates for a cluster of films, including laffer "Old Dogs," filmmaker Walt Becker's follow-up to sleeper box office hit "Wild Hogs." "Dogs," with a cast including John Travolta, Robin Williams and Seth Green, bows April 10, 2009. "Wild Hogs" opened in spring as well.
In a counterprogramming maneuver, Disney's "The Hannah Montana Movie" will debut May 1, 2009, opposite 20th Century Fox's "X-Men Origins: Wolverine."
Looking to Thanksgiving 2009, Bruce Willis futuristic cop actioner "The Surrogates" will unspool the weekend before the holiday on Nov. 20, 2009.
During the WGA walkout, studios weren't in a position to begin to round out their slates for 2009 or move pictures around, since they couldn't be sure how fast the production pipeline would be up and running. The majors are relatively confident that a new deal can be struck with actors without a walkout this summer.
Last week, Paramount made a number of changes, including moving J.J. Abrams' "Star Trek" from Christmas to May 2009.
Disney is the second studio to make a multitude of changes.
Disney rejiggered release dates for several titles, including action-adventure "Prince of Persia: The Sands of Time," which will now open June 16, 2009, instead of July 10, 2009.
The move means that "Prince of Persia" will open ahead of Par's "Transformers 2" (June 26, 2009) and "Ice Age III" (July 1, 2009) versus bowing in their wake.
As a result of claiming May 1, 2009, for "Hannah Montana," Disney moved 3-D animated pic "G-Force" out of that slot to July 24. That's the second 3-D title, as well as the second toon, to bow on that date after the Weinstein Co. horror entry "Piranha 3D" and New Line's animated adventure "Planet 51."
The Mouse House also has decided to make Isla Fisher-Hugh Dancy romantic comedy "Confessions of a Shopaholic" its 2009 Valentine's Day release, instead of Sandra Bullock-Ryan Reynolds romantic comedy "The Proposal," which will now be released Sept. 25, 2009 vs. Feb. 13, 2009, when "Proposal" debuts.
Disney dated two other films: Sci-fi family adventure-comedy "Race to Witch Mountain," starring Dwayne Johnson, will bow March 13, 2009, while Tim Burton's 3-D remake of "Alice in Wonderland" will unspool a week later on March 19, 2009.
In another tweak, Disney retitled two films: "South of the Border" (Sept. 26) becomes "Beverly Hills Chihuahua," while "High School Musical 3" (Oct. 24) becomes "High School Musical 3: Senior Year."
Meanwhile, Paramount has made an additional tweak on top of last week's changes, moving back D.J. Caruso's Shia LeBeouf thriller "Eagle Eye" one month from Aug. 8 to Sept. 26. That gives Par some breathing room now that it's releasing DreamWorks' Ben Stiller laffer comedy "Tropic Thunder" on Aug. 15.
On the specialty side, the Weinstein Co. announced this week that it will bow 2008 Sundance acquisition "Where in the World Is Osama Bin Laden," the Morgan Spurlock docu generating plenty of buzz, on April 18.

Tim Burton Denies Duping Ex
Parting isn't exactly sweet sorrow for Tim Burton.
The Charlie and the Chocolate Factory director has lashed out against ex-paramour Lisa Marie, denying allegations that he tricked her out of promised assets from their now defunct 10-year relationship.
"The suggestion made by [Lisa Marie] that I engaged in any conduct which was calculated to deceive her...is completely false and completely ludicrous," Burton says in a seven-page court declaration filed Thursday.
Burton's former leading lady sued him in 2006 for fraud and breach of fiduciary contract, alleging he cheated her out of an equitable division of their accumulated property when he dumped her for actress Helena Bonham Carter five years earlier.
Lisa Marie claims that the filmmaker agreed to bankroll her for life in exchange for serving as his personal manager and acting in his films.
Her suit seeks to rescind three previous legal settlements between them, accusing Burton of orchestrating a conspiracy theory—getting various friends and counselors, including her own lawyer, to convince her into accepting a smaller payout.
But Burton says bunk. "Allegations that I did, or intended to do, anything illegal, unethical or improper to cause [her] to sign agreements are complete fabrications," he states in his affidavit.
Burton says he went to great lengths to reach an amicable settlement, selling two apartment buildings he owned in New York and borrowing $3.5 million to pay her. He also claims to have forked over $715,000 to the IRS in gift taxes for one of his payments to her.
"My goal was to provide [Lisa Marie] with sufficient resources to permit [her] to take care of herself for the rest of her life, and had nothing whatsoever to do with any legal obligation," his statement says.
Burton's lawyer, Joseph Mannis, tells E! News he wants the complaint thrown out.
"We believe that the lawsuit is frivolous and have filed a motion for summary judgment," says Mannis. "Mr. Burton believes he was very generous in the amount of money he gave her and does not believe he owes her more.
"Mr. Burton also doesn't believe he did anything wrong."
The next hearing in the case is set for July 14.

Helena Bonham Carter Reveals Her 7-Month-Old's Name
It has been a long time coming, but director Tim Burton and actress Helena Bonham Carter have finally confirmed the name of their 7-month old daughter – Nell.
Born last Dec. 15 in London and revealed as a PEOPLE exclusive, Nell Burton had a gestation period for her name almost as long as the pregnancy itself. The creative couple had difficulty agreeing a moniker.
Bonham Carter, 42, confirmed the name during a phone interview with the Jewish Journal while on the set of Terminator Salvation in New Mexico.
Bonham Carter said her daughter was named Nell after "all the Helens in the family." The actress's mother is named Elena and her grandmother was called Helene.
The name originated during medieval times and is a diminutive of Helen. It was also widely popular in the U.S. at the start of the 20th century.
Rumors had surfaced previously that the baby was named Indiana Rose, however the reports were never confirmed by the couple, and a friend tells PEOPLE, "Her name was never going to be Indiana Rose."
Bonham Carter has now wrapped filming, and the family, along with four-year-old son Billy, is on vacation with partner Burton – who celebrates his 50th birthday on Aug. 25. Later this year the actress will appear on screens in the next Harry Potter movie.

Court orders end to suit filed by Tim Burton's ex
A long-running lawsuit filed by Tim Burton's ex-girlfriend over his assets should be dismissed, an appeals court has ruled.
The California Court of Appeals issued a ruling on Wednesday ordering a lower court judge to grant a motion by Burton's attorneys for a summary judgment.
The move halts a trial scheduled for next week that would have focused on the couple's nearly decade-long relationship, which ended in 2001.
Burton's longtime girlfriend, Lisa Marie, sued the director in 2006. She claimed that she was cheated out of money that Burton had promised her during their relationship.
Douglas Bagby, who is representing Burton, praised the ruling and said the suit should have never been filed.
Lara Ott, an attorney representing Marie, said late Thursday that she plans to appeal the ruling. She said she expects the case to eventually go to trial.
In court documents, Burton claimed he paid Marie $5.5 million. She signed an agreement relinquishing any claims to future assets and should return the payout if she did not want to abide by the contract, Burton has argued.
Marie countered in court filings that she felt coerced to sign the contract and that Burton promised to take care of her "financial support and needs for the rest of her life."
In July, Los Angeles Superior Court Judge Teresa Sanchez-Gordon denied a motion by Burton's attorneys to have the case thrown out. She can argue why her decision should be upheld, but must file a response by mid-September.

Bonham Carter: 'I Was A Corset Sex Symbol'
Helena Bonham Carter has claimed that she has become a better actor with age.
The actress starred in a number of E.M. Forster adaptations before taking on the against-type part of Marla Singer in David Fincher's 1999 movie Fight Club.
Bonham Carter told The Guardian: "Ageing has helped hugely. There's no question I'm a better actor, and you leave behind a certain typecasting.
"I was like the corset bimbo. Well, not quite bimbo, but you know what I mean. The corset sex symbol, I suppose. Now I'm not going to be the sex symbol, I'm going to be the granny. Well, not quite granny."
Regarding her career-changing role in Fight Club, she added: "It was Brad [Pitt]'s idea for me to be in it. In the six weeks when you're up for an Oscar, there's a little window where you're offered everything.
"Seventh week, when you haven't got it, you're f**ked. Forget it. So you have to get in there. I was offered so many nice parts, and I went for Fight Club."
Of her early career, she added: "I didn't know what the hell I was doing. I thought, f**k, I can't do this. I felt I was totally bluffing it. Now I'm much easier with it because I'm fundamentally happy."

'Chief' Parent Helena Bonham Carter
The 'Alice in Wonderland' actress - who raises son Billy, six, and two-year-old daughter Nell with her partner Tim Burton - admits the director prefers her to make the decisions in their household, but insists it doesn't make him a bad family man.
She said: "At home I'm the boss - he calls me 'chief' and I would say on the whole he likes me to make the decisions.
"He's not a mad professor type. His time management is good. He is financially responsible. A part of him maybe exists in an alternative reality but he is a very sane and grounded good father."
Despite their domestic attitudes, Helena admits her forthright nature can often lead to clashes when they work together, which they have done on five occasions.
She said: "At work is where we sometimes get it wrong. He's the boss and I'm not as silent as he'd like me to be."
