Lindsay's Battery 'Victim' to Cops: 'Back Off!'

The former Betty Ford employee who filed the battery report against Lindsay Lohan thinks the Palm Desert Police Department is out of line by gunning for LiLo, and thinks cops should "back off."

 

Dawn Holland, who was fired from Betty Ford after the December 12 altercation, tells TMZ, "Lindsay has got enough to deal with as is ... they just need to back off and let it go."

 

Holland is suspicious of the Palm Desert cops' motive, saying they seem to be going way out of their way to nail Lindsay.

 

Holland adds, "Jail is not going to rehabilitate her."

 

I wonder if there is a rider on Ms. Holland's settlement agreement with La Lohan that pays her whenever she says something positive in public? (In addition to the lump sum she has already received, of course)

Lindsay Lohan Case Referred to District Attorney

TMZ has learned ... Lindsay Lohan's fate is now in the hands of the Riverside County District Attorney, who will decide whether to charge her in the Betty Ford brouhaha with the former staffer.

 

The Palm Desert Police Department has turned its investigation over to the D.A., who will decide whether to charge Lohan with battery.

 

The case would be an uphill battle, because alleged victim Dawn Holland says she will not cooperate and does not want Lindsay prosecuted.

 

No word on when the D.A. will make a decision.

Yes, we realize that could be any number of young stars these days. But this particular trainwreck just so happens to be moving into a new $7,100-a-month rental in Venice, Calif. after a stint in rehab.

Call me suspicious but I think it's strange that the place next to her ex-girlfriend/drug dealer/whatever is available for rent the day she getd out of rehab.

It will be interesting to see if the speculation that the two Venice households are really a set up for a reality show is accurate. It would be a good thing for Sam's "career" but it would also signal that Lindsay realizes that her legit acting career is all but over. A reality show would put a nail in the coffin... hear that Lindsay? If someone is telling her otherwise (Dina), then they are just looking for a financial cut of the short-term action.

 

Any news on whether or not DWTS is still interested?

Lindsay Lohan is falling back into old habits -- TMZ has learned she's hanging out with Sam Ronson again, but they are not back together.

 

Sources tell TMZ the pair met up last night to have dinner in West Hollywood. We're told the new neighbors have been "getting along well" since LiLo moved in next door to SamRo -- but for now they are "just friends."

 

Being friends with your ex rarely ever works out well, but good luck girls!

Lindsay's Accuser Wanted For Sit-Down With D.A.

The Riverside County D.A. wants to take another run at Lindsay Lohan's accuser -- Dawn Holland -- in light of TMZ's report that Dawn made a $10,000 deal with LiLo ... law enforcement sources tell us.

 

As we first reported, sources tell us the plan was for Lindsay and Dawn to pose together for photos -- and for Dawn to make $10 grand off the sale of the pics.

 

We're told the district attorney will now extend an invitation to Holland to speak with them about the alleged assault incident at the Betty Ford Center. Up to this point Holland has refused to cooperate with investigators.

 

The D.A.'s Office refused to comment because it's an ongoing investigation.

LOS ANGELES (AP) - Lindsay Lohan is in the spotlight again for all the wrong reasons.

 

Police got a search warrant Tuesday to look for a $2,500 stolen necklace at the troubled actress' home near Venice Beach, a freewheeling boardwalk known for its mix of performers, tourist shops and seaside gym.

 

But before detectives could execute the warrant, someone - police wouldn't say who - turned in the necklace.

 

Police presented a potential case against the actress Wednesday afternoon, although prosecutors will not make an immediate decision on whether to pursue charges, district attorney's spokeswoman Sandi Gibbons said.

 

Los Angeles police Officer Bruce Borihanh said the department's investigation into the "Mean Girls" star was for possible grand theft.

 

The allegations bring more problems for Lohan, 24, who is still on probation for a 2007 drunken driving case and is also being investigated for possible battery on a rehab worker in December.

 

Phone and e-mail messages sent to Lohan's attorney, Shawn Chapman Holley, were not immediately returned.

 

Kamofie & Co., a Venice custom jewelry store, reported the necklace stolen on Jan. 22, roughly three weeks after the actress was released from three months of court-ordered rehab at the Betty Ford Center. The treatment, her fifth rehab session, came after she admitted failing a drug test shortly after being granted early release from another treatment program.

 

Regardless of the decision by prosecutors in Los Angeles and Riverside County, where Betty Ford is located, Lohan is due back in court on Feb. 25 for a probation hearing.

 

Jeff Kaman, the husband of storeowner Sofia Kaman confirmed that the necklace involved in the Lohan case was from Kamofie, but declined further comment, citing the police investigation.

 

The store is within walking distance of Lohan's home. Kamofie's jewelry is no stranger to celebrities - according to the store's website its merchandise has been featured in several celebrity magazines, including a photo of actress Amanda Seyfried in People magazine's "World's Most Beautiful" people issue last year.

 

Lohan's frequent legal troubles, including lawsuits and two rehab stints and two trips to jail in 2010 alone, have led to the actress appearing more in court than on the big screen in recent years.

 

Her role as porn star Linda Lovelace in a biopic was recast while Lohan was being treated at Betty Ford.

 

The case of the stolen necklace is the second active police investigation that could return the former Disney star to jail if a judge determines she has violated her probation. Prosecutors in Riverside County are considering whether to press battery charges against Lohan over a December altercation the actress had with a worker at a Betty Ford Center facility in Palm Desert.

 

Los Angeles Superior Court Judge Elden S. Fox warned Lohan at a hearing last year that he would send her back to jail if she violated the terms of her probation, which requires her to obey all laws and submit to frequent drug tests.

 

The investigation into the stolen necklace was first reported by celebrity website RadarOnline.com. Police would not release additional details about the item Wednesday.

Lindsay Tipped Off to Search Warrant

Sources connected with the Lindsay Lohan necklace caper tell TMZ ... they believe Lindsay was tipped off after the judge signed the search warrant yesterday ... and she returned the jewelry before her house could be raided.

 

We've learned the warrant was signed by Judge Katherine Mader at 3:45 PM Tuesday. The LAPD was making plans to execute the warrant -- which authorized cops to search for the necklace at Lindsay's home in Venice, CA.

 

But somehow -- before the search was conducted -- Lindsay's stylist showed up at an LAPD substation and returned the $2,500 necklace.

 

Sources connected with the case tell us ... they believe someone told Lindsay the warrant was in play. Otherwise, they say, why would she have her stylist go to the LAPD to return the jewelry rather than the jewelry store?

 

Our sources believe Lindsay tried making a preemptive move, but we're told ultimately returning the jewelry won't be a factor in deciding whether to prosecute her.

Wow, it sure does seem like the jewelry store is NOT going to back down on this. I can't wait until the full story comes out. I'm sure she was notified and told the store to go f*ck themselves.

The owner of Kamofie & Company claims Lindsay walked out with the $2,500 necklace on January 22, yet she did not inform the LAPD until the 23rd. Our sources say the jewelry store owner claims she tried contacting Lindsay's people on the 22nd to ask them to return the item, but couldn't reach anyone. Here's the snag ... the owner simply could have walked down the street and knocked at Lindsay's door.

 

Lindsay claims the store loaned her the necklace. Fact is ... jewelry store owners have thrown themselves at Lindsay, asking her to wear their stuff. The picture shows Lindsay on January 7, posing with another jewelry owner who gifted her an expensive necklace.

 

In order to charge Lindsay, the D.A. must prove she had a specific intention to permanently take the item as she walked out the door.

So WTF? They were supposed to decide by today whether to press charges or not.

 

I've managed to go my whole life without being on probation, without lying to a judge, without pounding on hospital employees and without STEALING from a jewelry store, and she's managed to do all that AND rehab in a period of a few months.

 

I'm completely disgusted that anyone would buy her leggings. I look forward to seeing them in a bin at Big Lots. I won't even buy them then.

TMZ must have misunderstood something. It doesn't make sense that a 1-day delay would mess up the DA's case. If they want to try and prove a burglary, then yeah, they need to prove she went into the store with the intention to steal. But that's very difficult to prove - even if they caught her walking out the door with the necklace, all she has to say is the theft was an impetuous act and unless she had some sort of burglary tool (like something to remove security tags). They can charge her with misdemeanor petty theft. But the kicker is, if someone is convicted of a petty theft and if they get caught doing it again, the charge is petty theft with a prior, and THAT'S a felony.

 

The girl has skated through 90% of lies to the court, probation violations, drug use, etc. She's heading on a path to the Anna Nicole Smith school of Out of Control.

Lindsay is accused of stealing a $2,500 necklace from a Venice, CA jewelry store on January 22. Surveillance video from the store shows Lindsay with the necklace in question and there are photos of her wearing what appears to be the same necklace a week later.

 

If convicted Lindsay faces a maximum of three years in state prison.

 

Sources connected with Lindsay tell TMZ, Lindsay says she'll fight the charge and she's sticking with her story that she took the jewelry on loan.

 

The case could also have a dramatic impact on her ongoing DUI case in Beverly Hills since she is currently on probation.

 

 

UPDATE: The D.A.'s office just issued a statement to an L.A. wire service that no decision has been made. TMZ reiterates -- Lindsay Lohan will be charged with felony grand theft.

This is just sad. It seemed after she was dumped by that guy from the 70"s show she was been on a downward spiral. One of my favorite movies is Freaky Friday and I thought she was so cute in that movie and had so much potential.

 

Oh it could be that I am totally in love with Mark Harmon and like the movie because of him. :4biggrin:

Lindsay Lohan Facing Three Years in State Prison Over Jewelry Theft

Lindsay Lohan hit headlines (again) last week when she was accused of stealing a $2500 necklace from a Venice boutique, which she claimed she simply borrowed and her stylist forgot to return, but the matter is turning into something much bigger than a mere miscommunication.

 

Lohan will be charged with felony grand theft as early as next week, according to TMZ, and faces a maximum three years in a state prison if convicted.

 

Los Angeles Criminal Defense Attorney, Steve Cron, told us she may very well be prosecuted over the incident - although it is hardly likely she would be sentenced to a full three years.

 

"There is a likelihood. It seems to me that she got caught stealing that necklace and it appears that somebody talked her into returning it a week later and had someone drop it off but it was too little too late. She had already stolen it, so I think she will get prosecuted," Cron surmised. "It's unlikely that she is going to get 3 years in state prison because although she's screwed up repeatedly on probation, but she certainly can get a lot more time in county jail. Judge Fox could give her 6 months for violating probation in Beverly Hills and another judge who hears the case on grand theft could decide to send her for more time in county jail or he could send her to state prison. It's more likely that she is going to go to an extended period in county jail. It wouldn't be 30 or 60 days, it's going to be a substantially longer sentence than that."

 

However, Lohan's camp is maintaining that she is absolutely innocent.

 

"We vehemently deny these allegations and, if charges are filed, we will fight them in court, not in the press," Lohan's attorney Shawn Chapman Holley told TMZ in a statement.

 

"This whole story is crazy. $2500 is tip money to Lindsay, if she wanted the necklace that badly she would have bought it," said our insider. "She's going to get to the bottom of this - it wasn't stolen."

Maybe the jewelry store knew this in advance to get a little extra cash in addition to the necklace? A little out there I know. To be honest, I think she was actually loaned the jewlery. But I bet the jewelry store thought she would wear it to some PR event and return it the next day. Isn't that the way these things usually work? Lindsay, probably just kept it longer because she liked it, or forgot to return it.

A year after a perceived slight from the E-Trade baby, the much hyped post-Super Bowl episode of "Glee" included an actual dig at Dina Lohan. After a cheerleading stunt gone wrong, Katie Couric informs Jane Lynch's Sue Sylvester that she beat out Lindsay Lohan's mom and her dog, "Sparky Lohan," to make the list of the world's biggest losers.

 

Well, she didn't just beat Dina. She also beat out Tiger Woods, the economy and 9 percent unemployment.

 

Considering this isn't the first time "Glee" has winked at the zeitgeist with a Lohan insult, did mama Dina's claws really come out this time?

 

"The show has targeted everyone from gays to lesbians, Asians, disabled and each other...several groups are going after the producers including mothers' groups," Dina exclusively tells E! News.

 

"It's a shame as the dance numbers are amazing, but the writers need to be nice and more creative as opposed to being hurtful. They are sending the wrong message to the youth that are watching. Oh, and I must get a 'fifth' dog named Sparky...as far as Katie Couric is concerned, she has a short memory when the tabloids were trashing her a few years ago—and she's a mom!"

 

Well, trashing someone for not pulling the CBS Evening News out of third place isn't exactly the same thing, but...OK.

 

Lindsay was, according to her mom, really upset after Gwyneth Paltrow, playing a substitute Spanish teacher on "Glee," taught her class phrases that meant "Lindsay Lohan is totally crazy, right?" and "How many times has Lindsay Lohan been to rehab?"

 

Last year, E-Trade's Super Bowl commercial featured a milkaholic baby named Lindsay, prompting the starlet (whose Cannes-to-court-to-Betty-Ford legal troubles were still ahead of her) to sue for $100 million, picking such a high figure presumably to make a point.

Lindsay Lohan can breathe easy...for now.

 

E! News has confirmed the Los Angeles County District Attorney's Office will not be charging the troubled starlet today with felony theft for allegedly swiping a $2,500 necklace—which means mom Dina Lohan, can go back to fuming over "Glee" dissing her on its post-Super Bowl broadcast.

 

So where's the Lindsay case stand?

 

"Absolutely nothing will be filed today," D.A. spokeswoman Jane Robison tells E! News.

 

Right now, longtime Lohan nemesis Danette Meyers (who prosecuted the actress's DUI case) is still going over the evidence presented last week by the LAPD.

 

If Meyers agrees with police that a felony charge is warranted then a criminal complaint will be filed. But because Lohan would be considered a nonviolent offender, the D.A. would not dispatch police to take her into custody. Instead, Team Lohan would would either negotiate a surrender or prosecutors would just set an arraignment date for her to appear.

 

.Over the weekend, Lohan attorney Shawn Chapman Holley issued a statement saying, "We vehemently deny these allegations, and if charges are filed, we will fight them in court, not in the press."

 

Meanwhile, sources close to the Lohan family seem to be in denial about the seriousness of the alleged felony, which carries a maximum three-year state prison sentence.

 

"No one [in the family] really thinks she's going to get charged," said the family insider. "They believe she didn't steal the necklace. They think it's a non-case."

 

After all, mom Dina has more importaint things to fixate on, like getting dissed on "Glee" when on last night's episode Katie Couric branded Jane Lynch's Sue Sylvester the "Loser of the Year," besting Dina for the honor.

 

That's criminally funny.

TMZ has learned ... Lindsay Lohan will be charged with felony grand theft tomorrow.

 

Sources connected with the case tell us ... the single count of felony grand theft will be filed at Airport Court in L.A. Wednesday morning.

 

Lindsay will be arraigned at 1:30 PM. She must be present for the hearing.

 

Lindsay will be charged with stealing a $2,500 necklace from an L.A. jewelry store.

 

If convicted, she could be sent to California State prison.

My understanding of what it means to be on probation is that you can't even get caught jaywalking without being in a buttload of trouble. The February 25th hearing should be interesting.

I have become super jaded after watching her walk over and over and over again. Even the "harshest" punishment wasn't very harsh. I'll believe it when I see it - money really can buy everything.

Lindsay Lohan has been officially charged with felony grand theft ... TMZ has learned. The case has just been filed.

 

 

Lindsay is accused of stealing a $2,500 necklace from a Venice, CA jewelry store on January 22. Surveillance video from the store shows Lindsay walking out with the necklace, which is partially hidden by other jewelry around Lindsay's neck.

 

Prosecutors recommended Lindsay's bail be set at $20,000. If convicted of felony grand theft, according to the charging documents Lindsay could face up to three years in state prison.

 

 

 

Lindsay will be arraigned today at 1:30 PM PT -- we'll livestream the hearing so stay tuned.
