You are half right. I just looked it up. Mark Heller is licensed in NY, but is not licensed to practice in California and was once suspended from practicing law for five years. I'm guessing her "benefactor" is connected with this guy somehow and that is how she found him. She certainly cannot afford her legal bills.

Lindsay Lohan Smelled of Booze After Crash

Lindsay Lohan may have been drinking just before she crashed her Porsche last June on Pacific Coast Highway ... TMZ has learned. Nevertheless, prosecutors are offering her a brand new plea deal that does NOT involve jail.

 

Law enforcement sources tell TMZ ... a bottle of alcohol was found next to Lindsay's Porsche, and we're told her breath smelled of alcohol. For some reason, cops did not perform a field sobriety test at the scene of the crash.

 

Sources tell us ... the Santa Monica City Attorney is prepared to offer Lindsay 60 days in a residential rehab facility in her lying-to-cops case -- where she said she wasn't driving the Porsche. That's 4 months less than the original offer.

 

In addition, we're told the City Attorney wants Lindsay to attend another set of AA meetings. And he wants her to do community service. We're told the prosecutor will let her do the community service in New York City, but -- unlike Chris Brown -- it must be closely monitored.

 

The wild card is that the L.A. City Attorney is also involved in the case because they're handling the jewelry heist case where Lindsay is still on probation. Up to now, we're told the L.A. City Attorney wanted jail time for the probation violation, but the prosecutor may back off that position.

 

The plea bargain meeting between prosecutors and Lindsay's lawyer, Mark Heller is today ... so stay tuned.

Judge refuses to delay Lindsay Lohan trial

LOS ANGELES (AP) -- A judge refused Friday to delay Lindsay Lohan's trial on reckless driving and other charges and admonished her attorney, saying the lawyer needs help on the case.

 

Superior Court Judge James R. Dabney advised New York lawyer Mark Heller that his pleadings weren't appropriate under California law.

 

Heller was told to get assistance from another attorney or Lohan would be required to attend hearings to gauge his ability to represent her.

 

The actress wasn't obligated to attend Friday's hearing. Heller said after the hearing that while his motions didn't conform to California law, he was simply trying to protect Lohan's rights and would continue to do so.

 

Dabney also said there was no good reason to delay the March 18 trial, noting that he was skeptical that more time would allow Lohan to demonstrate she had changed after years of run-ins with the law.

 

"I don't know how the next two weeks is suddenly going to change the history of this case, these cases," Dabney said.

 

Lohan has pleaded not guilty to misdemeanor charges of reckless driving, lying to police and obstructing officers after her sports car crashed in June as she and a passenger headed to a movie shoot.

 

Lohan was on probation in a theft case at the time.

 

Heller had sought a delay as he works with prosecutors to reach a plea deal that could allow Lohan to pursue inspirational speaking or other community service.

 

The attorney rejected the notion that the actress needs rehab, noting that she has been sentenced to treatment several times before and she still ends up in trouble. "This is not what she needs — rehab," Heller said.

 

He said Lohan is engaged on one-on-one psychotherapy.

 

"Lindsay doesn't have a problem with alcohol and drugs," he said. "Lindsay's issues are different," he said, declining to elaborate further.

 

Lohan could face a return to jail if she is convicted, or if a judge determines she violated the terms of her sentence in the 2011 necklace theft case.

LINDSAY LOHAN MISSES FLIGHT Tempting Fate with Court

 

Lindsay Lohan's travel history is as sketchy as her driving history ... and her rehab history ... and her dating history ... and TMZ has learned she missed a flight to Los Angeles last night, with her court date looming Monday.

 

 

LiLo is scheduled to appear in court tomorrow to begin her trial for allegedly lying to cops last summer following her crash on PCH. Law enforcement sources tell TMZ that Lindsay MUST be there in person or else a bench warrant will be issued.

 

Sources close to Lindsay tell TMZ she had a flight scheduled from NY to LA yesterday at around 9:00 PM ET ... but skipped it. Instead, Lindsay was at a club in New York to see a band called City of the Sun.

 

We're told Lindsay is trying to schedule a flight for later today, but has yet to do so.

 

Lindsay's history of missing flights is rather prolific -- she missed a court date in 2010 after she claimed to lose her passport. Last April, Lindsay missed her flight to the White House Correspondents' Dinner after she "couldn't get herself together."

 

The hearing is expected to start at 8:30 AM PT and we'll have it for you live.

 

1:20 PM PT -- According to our sources, Lindsay now has a flight booked for 6:00 PM ET. As for whether or not she'll be on it, your guess is as good as ours.

Lindsay Lohan Gets Off Airplane Right Before Takeoff!!!

 

 

Lindsay Lohan is now in SERIOUS jeopardy of missing her court date tomorrow -- TMZ has learned she got off her flight to Los Angeles at the last minute and is now scrambling to find another way to the west coast.

 

Lindsay arrived at JFK a few hours ago after deciding NOT to fly back on Saturday as previously planned.

 

We're told Lindsay was on board the plane when for some reason ... she decided to get off. According to our sources, Lindsay was in such a hurry to get off the plane, she left her bags behind.

 

Sources close to Lindsay tell TMZ she believed there was a problem with the plane ... specifically that fuel was leaking. Lindsay is telling friends that 35 other people got off the plane as well because they too felt it was unsafe.

 

For whatever it's worth ... according to the website for the airport, the flight was delayed an hour taking off and has since been diverted to Las Vegas. [uPDATE: The airline tells TMZ the plane is in fact stopping in Vegas for more fuel before continuing to Los Angeles.]

 

Our sources say LiLo is now in an airport lounge ... calling, texting and emailing everyone she knows ... trying to get a private plane to take her to L.A.

 

Law enforcement sources tell TMZ she MUST appear at the hearing tomorrow or the judge will issue a bench warrant.

Lindsay Lohan OFFICIALLY SCREWED

 

Lindsay Lohan's court hearing is less than three hours away and she still has not arrived in Los Angeles ... TMZ has learned.

 

As TMZ first reported, LiLo hopped off her scheduled flight from New York to Los Angeles just before take off last night because she felt the plane was unsafe.

 

Lindsay eventually found a flight, tweeting at around 4:00 AM PT and thanking Mr. Pink -- an energy drink company -- for lending her a private jet.

 

According to our sources, the flight won't land in Los Angeles until around 6:30-7:00 AM PT ... meaning Lindsay has roughly 1.5 hours to make it to court, which starts at 8:30 AM PT. It might be enough time, but you have to factor in that Lindsay needs to make herself "camera ready."

 

And then there's this ... we know Lindsay's plane is set to land at the airport in Van Nuys. That means she has to travel around 20 miles to get to the hearing today at the Airport Courthouse. And it's gonna be rush hour!

 

According to our sources, Lindsay is not alone on the flight. She's traveling with her ex-assistant Gavin. He was the one who rolled on Lindsay and told the cops she was driving the car (despite her claims otherwise). The incident played a major role in their decision to charge her with lying to police.

 

Lindsay could have avoided all of this if she stayed on her original flight to LA. Even though it took off an hour late and was diverted to Las Vegas ... it still arrived in Los Angeles last night at 11:30 PM.

 

But if Lindsay made smart decisions, we wouldn't be in this mess in the first place.

 

UPDATE

Lindsay Lohan will absolutely, positively be LATE for her trial TMZ has learned ... and the judge could issue a bench warrant for her arrest on her first day of trial.

 

We've learned ... the private jet that is carrying the infamous defendant is scheduled to land at 8:11 AM in Van Nuys, 20 miles from the courthouse. That means at the time of touchdown, assuming she lands on time, she will have 19 minutes to get to the courthouse in the middle of rush hour traffic. Translation: No way in hell.

 

Sources tell us ... the jet was delayed at JFK in NYC and didn't go wheels up until 6 AM EDT.

 

There are 2 SUVs waiting at Van Nuys airport to take Lindsay and her entourage to court.

 

One more complication .... Lindsay left all of her luggage on her original commercial flight. Someone has already retrieved the bags at LAX and has taken them to the Van Nuys Airport. Lindsay will change clothes in the car.

 

One final thing ... Guess how much the private jet costs? $50,000. Lindsay didn't pay -- The generous folks at Mr. Pink energy drink covered the tab.

LINDSAY LOHAN COPS PLEA DEAL AVOIDS JAIL

 

Lindsay Lohan just copped an 11th hour plea deal and will spend 90 days in lock down rehab ... the good news for her ... she's dodged the jail bullet.

 

After a lot of haggling in chambers with offers and counteroffers, Lindsay pled no contest to the crimes of reckless driving and lying to cops. In addition to rehab, Lindsay will perform 30 days of community labor and undergo psychotherapy for 18 months -- she'll get credit for shrink time already completed.

 

FYI -- there's a mandatory 5 days in jail for reckless driving, but it's going to be folded into the lock down rehab so she won't be behind bars even for a day. Lindsay will be able to do her rehab in NYC. She must stay clear of drugs and drug users. She must submit to drug testing.

 

She's also admitted to a probation violation in the jewelry heist case, she was sentenced to 180 days in jail, but that sentence was STAYED and she won't do time if she continues to obey all laws.

 

Lindsay showed up -48 minutes late after missing 2 commercial flights from NYC to L.A. She took a private jet and landed a little too late.

 

On her way in, someone threw glitter at Lindsay.

LINDSAY LOHAN NY 'Lockdown Rehab' Sentence NO SUCH THING!

 

Now we know why Lindsay Lohan was so nonchalant when she was sentenced to 90 days in a "lockdown" rehab facility -- It doesn't exist in New York ... and it's possible Lindsay could now go to JAIL as a result.

 

We've done some digging, contacting numerous rehab facilities in NY, and we're getting the same story from EVERYONE -- rehab facilities do NOT force patients to stay. In fact, an official from the New York State agency that regulates rehab facilities tells us lockdown rehab does not exist in NY.

 

None of the facilities have guards that block access out.

 

As for Lindsay ... she has a history of leaving rehab, even if the program requires her to stay inside. Two cases in point -- sources say Lindsay frequently snuck out of Cirque Lodge in Utah. And, of course, there's Betty Ford, where Lindsay allegedly got into a physical fight with an attendant who was about to blow the whistle on her for sneaking out.

 

Law enforcement sources connected with Lindsay's lying-to-cops case tell TMZ ... prosecutors offered the plea deal based on the representation of Lindsay's lawyer, Mark Heller, that New York had lockdown rehab facilities.

 

After we placed calls today ... we're told prosecutors are now checking to see if Heller's representation was false. One well-placed source said this: "The sentence was actually 90 days in custody, and lockdown rehab would satisfy that. If there's no such thing, then she'll go to jail for 90 days."

You do not need to be licensed to practice in Calfornia under special circumstances -- you have to petition the court to appear Pro hac vice (IPA: [prəʊ hæk 'vi:tʃei]), Latin: "for this occasion" or "for this event" (literally, "for this turn"),[1] is a legal term usually referring to a lawyer who has not been admitted to practice in a certain jurisdiction but has been allowed to participate in a particular case in that jurisdiction.

 

Usually you have to show that you have some special expertise -- what special expertise is need to represent someone on a DUI I do not know ---

Lindsay Lohan says she stole NOTHING from "Anger Management" -- She's telling friends she had a deal with producers she could take all the stuff she wanted, and they'd just deduct it from her salary.

 

Lindsay acknowledges, she walked off with 2 bracelets, a necklace, sunglasses, a pair of shoes, gold earrings, a silk bathrobe, lingerie and tap shorts. She claims the wardrobe person was well aware she had the goods and claims the wardrobe lady specifically said it was A-OK and the cost would be deducted from her salary.

 

Lindsay's also telling friends, she's NOT going to return the stuff, because as far as she's concerned she paid for it.

 

Here's the problem. Sources from the show tell TMZ ... Lindsay walked off with the bracelets, the necklace, earrings and shoes BEFORE there was any discussion about leaving with the stuff. We're told the wardrobe person told producers she was not going to become a cop and block Lindsay from leaving the set with her stuff, so she told her the value of "all missing items" would be deducted from her paycheck.

The private party was assumed to be a ‘safe place’ to engage in illegal activities until the cops arrived after complaints about the noise. The house was full of some of Los Angeles hardest party kids and even they were worried about the young star that certainly knows her way around a courtroom!
